Terms of Service

QIQSER, operated by Qalser Inc., provides an AI-powered acting coaching platform that combines advanced artificial intelligence with proven acting methodologies. Our services include:

• AI Coaching Sessions: Real-time voice coaching sessions using OpenAI's advanced language models and our proprietary four-dimensional coaching framework
• Screenplay Analysis: Upload and analyze screenplays using AI-powered scene extraction and dramatic unit analysis
• Scene Breakdown: Detailed scene analysis including character objectives, dramatic units, and given circumstances
• Video Recording and Analysis: Record and analyze acting performances with AI-powered feedback
• Performance Analytics: Track progress and improvement through comprehensive analytics and metrics
• AI Agent Collaboration: Work with specialized AI agents for different aspects of acting training

The Service is provided on a subscription basis with both free and paid tiers. Service features and availability may vary based on your subscription level.

To access certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

Age Requirements: You must be at least 18 years old to use the Service. If you are between 13-17 years old, you may use the Service only with the active involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service in any way that violates any applicable federal, state, local, or international law
• Upload or share content that infringes on intellectual property rights of others
• Upload copyrighted screenplays or scripts without proper authorization
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Attempt to gain unauthorized access to any portion of the Service or any systems or networks
• Use any robot, spider, or other automatic device to access the Service
• Introduce viruses, trojan horses, worms, or other malicious code
• Harass, abuse, or harm another person through the Service
• Share your account credentials with others
• Use the Service to train competing AI models or services

Violations of this section may result in immediate termination of your account without refund.

Our Content: The Service and its original content (excluding user-generated content), features, and functionality are owned by Qalser Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content: You retain all rights to content you upload to the Service, including screenplays, videos, and other materials ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your User Content solely for the purpose of providing and improving the Service.

Screenplay Rights: You represent and warrant that you have the necessary rights to upload any screenplay content. You are responsible for ensuring you have proper authorization for any copyrighted material you upload.

AI-Generated Content: Feedback, analysis, and coaching content generated by our AI systems are provided for educational purposes only. We do not claim ownership of creative work you develop based on AI coaching, but we reserve the right to use anonymized session data to improve our Service.

IMPORTANT: AI COACHING LIMITATIONS AND CAREER DISCLAIMER

Our AI coaching services use advanced artificial intelligence technology to provide acting guidance and feedback. However, you acknowledge and agree that:

• Educational Purpose Only: QIQSER is an educational platform designed solely for acting training and skill development. The Service is NOT a talent agency, casting service, career counselor, or employment service.
• No Career or Audition Guarantees: We make absolutely no guarantees, representations, or warranties regarding: (a) your success in any audition, casting call, or performance opportunity; (b) obtaining employment, roles, or work in the entertainment industry; (c) career advancement or professional success; (d) income, earnings, or financial outcomes from your acting career.
• Not Responsible for Professional Outcomes: Qalser Inc. is not responsible for any professional outcomes, career decisions, audition results, casting decisions, or employment opportunities (or lack thereof) that may or may not result from using our Service.
• Not a Substitute for Human Coaching: AI coaching is a supplementary educational tool and does not replace professional human acting coaches, agents, managers, or career advisors.
• AI Limitations: AI systems may occasionally produce inaccurate, incomplete, or inappropriate responses. You should use your professional judgment and not rely solely on AI feedback for career decisions.
• Your Sole Responsibility: Your acting career, professional decisions, audition preparation, and career trajectory are your sole responsibility. You agree to take full responsibility for all professional and career decisions you make.
• Data Usage: Your coaching sessions may be analyzed to improve our AI models. Personal information is not shared with third parties except as described in our Privacy Policy.
• Third-Party AI: We use OpenAI's technology for AI coaching. OpenAI's terms and policies also apply to the use of AI features.

BY USING THIS SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT: (1) THE SERVICE IS FOR EDUCATIONAL PURPOSES ONLY; (2) WE MAKE NO GUARANTEES ABOUT AUDITION SUCCESS, CAREER ADVANCEMENT, OR EMPLOYMENT; (3) YOU ASSUME ALL RISK AND RESPONSIBILITY FOR YOUR PROFESSIONAL CAREER DECISIONS; AND (4) YOU WILL NOT HOLD Qalser Inc. LIABLE FOR ANY CAREER OUTCOMES.

You use AI coaching services at your own risk and discretion. We are not liable for any decisions you make based on AI-generated feedback or coaching.

Video Recordings: The Service allows you to record and store acting performances. You acknowledge that:

• You own all rights to videos you record using the Service
• Videos are stored securely using Mux video processing services
• Videos are private by default and only accessible to you unless you explicitly share them
• We may use anonymous video analytics data to improve the Service
• You are responsible for ensuring you have rights to perform and record any copyrighted material
• We reserve the right to remove videos that violate these Terms or applicable laws

Video Storage: Videos are stored for the duration of your active subscription. Upon account deletion, all data including videos will be permanently deleted within 30 days, except as required by law or for backup recovery purposes (up to 90 days). We recommend backing up important videos externally.

Live Sessions: Real-time coaching sessions are conducted via Stream Video technology. Sessions may be recorded for your review and our quality assurance. You consent to such recording by participating in live sessions.

Subscription Plans: QIQSER offers both free and paid subscription plans. Paid plans provide access to additional features and higher usage limits.

Free Tier Limitations: Free accounts are subject to the following limits:

• Maximum 3 screenplays
• Maximum 2 AI coaches
• Maximum 5 meetings per month
• Maximum 3 voice sessions per month (5 minutes total)
• Maximum 3 video recordings per month
• Maximum 3 scene analyses and 2 beat+line analyses per month
• No performance evaluations (Creator+ feature)

Payment Processing: Payments are processed securely through Stripe. By subscribing to a paid plan, you agree to Stripe's terms of service and privacy policy.

Billing: Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees due.

Price Changes: We may change subscription prices at any time. Price changes will apply at the start of your next billing cycle. We will notify you at least 30 days in advance of any price increases.

Auto-Renewal: Subscriptions automatically renew unless you cancel before the renewal date. You can cancel anytime through your account settings.

Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• Your account will automatically downgrade to the free tier at the end of the billing period
• No refunds will be provided for partial billing periods
• Your content and data will be preserved (subject to free tier storage limits)

Refund Policy: All subscriptions (monthly and annual) are non-refundable. By subscribing, you acknowledge and agree that no refunds will be provided for any reason, including but not limited to: partial billing periods, unused features, dissatisfaction with the Service, or early cancellation. You may cancel your subscription at any time, and you will retain access until the end of your current billing period.

Account Termination by Us: We reserve the right to suspend or terminate your account for violations of these Terms. In such cases, no refunds will be provided.

Account Deletion: You may request permanent deletion of your account by emailing support@qiqser.com. Upon deletion, all your data will be permanently removed within 30 days, except as required by law.

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy.

By using the Service, you acknowledge that we collect and process:

• Account information (name, email, profile data)
• User-generated content (screenplays, videos, coaching session transcripts)
• Usage data and analytics
• Payment information (processed securely by Stripe)

We use this data to provide and improve the Service, including training and improving our AI models. We do not sell your personal information to third parties.

DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• The quality of any products, services, information, or other material obtained through the Service will meet your expectations
• Any AI-generated content or coaching will be accurate, complete, or suitable for your needs
• Using the Service will result in any career success, audition success, employment, or professional opportunities
• The coaching, feedback, or analysis provided will lead to improved acting ability or career outcomes

NO LIABILITY FOR CAREER OUTCOMES

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT Qalser Inc. SHALL HAVE NO LIABILITY WHATSOEVER FOR: (A) ANY AUDITION OR CASTING OUTCOMES; (B) ANY EMPLOYMENT OR CAREER DECISIONS; (C) ANY LOST OPPORTUNITIES, ROLES, OR WORK; (D) ANY FINANCIAL LOSSES RELATED TO YOUR ACTING CAREER; OR (E) ANY OTHER PROFESSIONAL OR CAREER-RELATED OUTCOMES.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Qalser Inc., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, LOST CAREER OPPORTUNITIES, OR ANY DAMAGES RELATED TO YOUR PROFESSIONAL ACTING CAREER, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Governing Law: These Terms shall be governed by and construed in accordance with the federal laws of Canada and the laws of the Province of Ontario, without regard to conflict of law provisions.

Dispute Resolution: Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by ADR Chambers (Canada) in accordance with its Arbitration Rules. The arbitration shall take place in Ontario, Canada.

Class Action Waiver: You agree to bring any disputes in your individual capacity and not as a plaintiff or class member in any class or representative action.

Jurisdiction: Any disputes shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

Qalser Inc. is a Canadian corporation operating under federal and Ontario provincial laws. Nothing in these Terms is intended to exclude, restrict, or modify any consumer rights under the Consumer Protection Act, 2002 (Ontario) or other applicable Canadian consumer protection legislation that cannot be excluded, restricted, or modified by agreement.

Your Rights Under Canadian Law:

• Right to Clear Information: You have the right to receive clear, comprehensible, and prominent disclosure of all material facts related to the Service before entering into this agreement.
• Right to Fair Practices: We will not engage in unfair, false, misleading, or deceptive consumer practices as prohibited by the Consumer Protection Act, 2002.
• Right to Cancel: For certain types of agreements, Ontario law may provide you with a cooling-off period or other cancellation rights. Where applicable, these rights cannot be waived.
• Right to Complain: You may file complaints with the Ontario Ministry of Public and Business Service Delivery or contact Consumer Protection Ontario at 1-800-889-9768.
• Electronic Commerce: This agreement complies with requirements under the Electronic Commerce Act, 2000 (Ontario) for internet agreements.

Currency and Pricing: All prices displayed on QIQSER are in United States Dollars (USD) unless otherwise indicated. Canadian consumers are responsible for any currency conversion fees charged by their payment provider.

PIPEDA Compliance: We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) regarding the collection, use, and disclosure of personal information. For details, see our Privacy Policy.

Anti-Spam Legislation: We comply with Canada's Anti-Spam Legislation (CASL). We will only send commercial electronic messages with your express or implied consent, and you may unsubscribe at any time.
